Guest Agreement and Declaration

Destination Unlimited Treks and Expeditions Pvt. Ltd (hereinafter referred to as “the Company”) is a reliable and a fully licensed firm that is legally registered under various departments of the Government of Nepal (Registration Number – Company Registration Number). The Chairman of the company is Mr. Niroula who has been working in this sector for several years now. The company is located at Thamel Marg, one of the most happening places in Kathmandu. Destination Unlimited Treks and Expeditions Pvt. Ltd aims to offer quality services to people (the customer) from all over the world.

 

Prior to booking any trip at the company, we suggest you to thoroughly and carefully read the terms and conditions provided below. After agreeing to these conditions, clients will be legally bounded to the company’s contract that clarifies all the ideas, information, permissions and deals established between the client and the company. The agreement covers almost every issue and procedures including Booking Confirmation, Payment, Refund, Cancellation and other charges levied as per policy and the Company’s Privacy Policy required for a successful journey.

 

It is essential to take further actions by building a strong legal foundation and relationship with the client to avoid any complications in the future. 

 

Terms and Conditions of Use

Booking

Clients have to go through various procedures with Destination Unlimited Treks and Expeditions Pvt. Ltd in order to book the trips. Please note that the term “Trip” in the website refers to all the itineraries designed for various trips and adventures including trekking, tours, sightseeing, hikes, and expeditions. 

 

To book a trip with Destination Unlimited Treks and Expeditions Pvt. Ltd, you will have to fill up the Booking Application Form and send it to us. Furthermore, to confirm your booking, 20% of the total trip cost must be paid prior the trip as a deposit and that amount will be non-refundable. However, there’s an exception for trips to Tibet and Bhutan, for which you will have to pay 50% of the total cost in advance. You will have to pay the rest of the 80% (50% for Bhutan and Tibet’s trip) balance due on arrival in Kathmandu before we start the trip. The remaining documents will be provided to you after completion of the whole procedures after the company has received the total cost for the trip. 

 

Payment Options and Method

The company offers two feasible and safe options for payment i.e. Bank Transfer and Credit Cards (Master/Visa/American Express/Union Pay/JCB/SCT Card). The clients must clearly mention the mode of payment as well as provide the company with all the required details about the Credit Card while filling the Booking Application Form. However, the balance due (80% of Nepal trips and 50% of Tibet and Bhutan trips) must be paid to the company in cash before departing for the trip from Kathmandu.

All payments made via Credit Card is subject to 4% surcharge. Surcharges apply to all payments including deposits, final balances, trip extension and miscellaneous purchases. Please be aware that this charge is levied upon the customers by the credit card payment service provider (i.e. Name of Bank) and not by the company. These charges are in the benefit of the customer as it provides consumer protection for the services purchased, in accordance with the terms and conditions pertaining to the credit card being used.

 

Note: In case of trip extension up to 10 days and more, the client’s will be charged an additional cost of USD 100 to USD 200, respectively. However, this additional charge is only for single supplement, additional USD 250 will be charged for climbing/expeditions. 

 

Cancellation:

 

The company holds no responsibility for a voluntary withdrawal or cancellation of trip by the customer themselves, hence the amount paid to the company will not be refunded after the trip has begun. If during the trip, any services such as accommodation, sightseeing, meals, transportation, etc. that was included in the itinerary/trip is not used by the customers, no refunds or reuse will be provided to whatever portion remains unused in the trip. The company will use their discretion in setting the conditions for the refunds, therefore, few of the conditions mentioned is subjected to change. The company holds every right to cancel the trips booked by the customers before it is guaranteed to run or an official agreement is signed. A trip is guaranteed to run once it has two fully paid travelers, unless minimum numbers state otherwise.

 

Unfortunate circumstances such as unforeseen natural disaster, canceled flights, strike, industrial action, wars, riots, quarantine, government intervention, weather, deteriorating health condition of the group member, etc. could lead to cancellation of trips. In such cases, the customer can either ask to get back the 80% of the total trip cost paid to the company (13% Government Tax will be deducted) or reuse the cost in an alternative trip with the same price immediately in the following season of the same year. However, the booking deposit i.e. 20% of the total amount remains non-refundable. 

 

The company will require a written notice in case of any cancellation. Please ensure the date of the trip cancellation is the date on which the written cancellation is received by the company. If you cancel the trip a month prior to the departure date of the actual trip, 100% of the total cost is reusable for about a year. Likewise, you can reuse a 100%, 80% and 50% of the total charged amount if the company gets a cancellation notice a month, 15 days and 7 days, respectively prior to the departure date of the actual expedition. 

 

 

 

Trip Amendment:

 

First and foremost, please note that all the amendment conditions are applied to the trips listed on this site only. Below are a few notes to take about the amendment fees in case of any changes during, while or after the booking:

 

If the company receives a request on the booking amendments at least 60 days prior to the trip, a total of USD 50/person is charged to the customer. However, if the customer’s request for a booking amendment in less than 60 days before the trip departure, then the charges will be as per the cancellation policy mentioned above. In case of any changes in the price of the trip during the procedure of booking and the amendments, the new cost will be applied to the trips. These changes might not be applied by the company, but can be levied upon the company by the third parties i.e. the hotels or the service providers working with the company. 

 

Any changes, amendments or additions in aggregation to the trips you have booked for example, hotels, transfers, additional days, etc. will account to an additional administration fee of USD 20/booking per change. These additional charges are imposed by hotels, ground operators or airlines and not by the company.

 

Please note that the amendments will not be made within 10 days of the original departure of the trip. However, if the changes are to be made (although rare), a minimum of USD 50 or over will be charged.

 

Travel Insurance:

Destination Unlimited Treks and Expeditions requires you to have a travel insurance package. The insurance must include medical coverage, air ambulance and helicopter rescue services. We also strongly recommend our clients to get a cancellation insurance to be on the safe side as not every policy covers, or restricts a cover for this type of travel. Kindly ensure that the insurance policies provide all the protection and cover almost every travelling activity that you take up. 

 

We will require a copy of your insurance paper for proof during the trip. By any reason, if you are unable to provide us with the insurance certificate, you will be asked to make a suitable policy/agreement then and there itself. However, if you are unable to do that due to circumstantial issues, you will be forbidden to continue your trip. Also, you will not be entitled to any refund for the services not provided.

 

Passport and Visa:

Travelers should carry a valid passport along with the visas of the country they are traveling to. We request our clients to make sure that their passports are valid up to at least 6 months beyond the total duration of their holiday. Kindly recheck your visas to ensure that they are of the right travel destination. The company will not be liable if travelers are returned or not allowed to enter the country due to the carelessness of the clients with regards to visa documentation and passports. 

 

Facilities and Flexibility:

Destination Unlimited Treks and Expeditions’ trip contains different types of trips that involves activities that is different from the standard holidays that travelers are accustomed to. These trips involves a certain level of difficulty that pose risks of illness, accidents and circumstances that are not easy to deal with, especially when you are in a remote area. The remote areas lack basic medical facilities and to receive an immediate help is quite challenging. Also, political instability and natural calamities that could occur en-route is unpredictable. Therefore, the company will not be responsible to such accidents and clients should agree to assume all the risks associated throughout the journey. As a whole, in case of any unavoidable circumstances, travelers should be open to changes in the plan and should be flexible with impromptu plans, reroutes, accommodations and transports. Additionally, if amendments and alterations in the itinerary are required to be made during the trips due to circumstances that are unavoidable and uncontrollable by the company, the customers will have to bear all the extra charges resulted by the alterations. There are possibilities of shortening the trips and rerouting, although it’s very rare.

 

As Destination Unlimited Treks and Expeditions will be providing you with a guide/expert to lead the group throughout the trip, you must accept the authority of the trip leader and cooperate with him/her at all times. Travelling in a group can be quite difficult, as the leader will have to respect every individual’s desires and physical abilities. For that, adjustments will have to be made in order to maintain a harmony. You have to understand that the company holds every right to accept or retain any person as a member of the group at any time during the trip. 

 

The company operates with the help of an association with third parties that includes, government agencies, members that assist in tours and treks, etc. The company has acknowledged the potential, reliability and qualities of these third parties to the most of its extent and is in a contract with them. However, there are times when incidents could take place during the trips due to these third parties, resulting in injuries, damage, loss, delay or irregularities. The company will not be accountable for these unfortunate incidents. Also, the company is not to be blamed for and will hold no responsibility for the rules and regulations and laws broken by the traveler of any country visited.

 

Most of the Trip prices exclude the following:

Personal travel insurance, both Emergency medical and evacuation

Visa and passport charges

International flight to/from Nepal and airport taxes to the respective countries if any.

Extra meals, transport cost, accommodations, costs and other expenses not included in the itinerary

Laundry, postage, personal clothing (unless provided in the itinerary), medical expenses and items of personal nature

Emergency evacuation and/or searches 

Tips and excess baggage charge

 

Kindly refer to the trip inclusion page along with the itinerary for each trip. The head office of Destination Unlimited Treks and Expeditions in Thamel Marg, Kathmandu or specified hotel will be your meeting point before departing for the trip unless you are specified otherwise. 

 

Note: The trip cost includes all domestic airport transfers.

 

Health Conditions:

The company will require a well-documented medical certificate from a valid medical institute before departing for the trip. We need to be sure about the well-being and health condition of the traveler. The company must be informed about any type of medical issues or conditions at the time of the booking itself. The company will not be responsible for any type of mishaps and will not bear the medical and evacuation expenses on behalf of the participant. Therefore, we request our clients to kindly consult their doctors for a thorough checkup and vaccination before booking a trip with us.

 

Weather and other unfavorable conditions:

Clients should be well aware about the unpredictability of the weather conditions in the mountainous regions. The unfortunate weather conditions especially in the Everest, Jomsom and Kanchenjunga regions where the climates are extreme, can sometimes lead to unfavorable circumstances that includes delay or cancellation of flights. The company will make sure that the expenses of accommodations and food is covered by the company in the departing city until the arrangement of flights are done. However, the company holds every right to reroute the original trek or transports which will be in favor of the situation without any addition in the cost. Please note that the company will not be responsible for any missed international flights, accidents occurred by Altitude Sickness or any other unpredictable circumstances and the participants will have to pay all the charges incurred. Nonetheless, the company will connect and assist you to make the necessary alternative arrangements, but the additional charge will be covered by the customersthemselves. 

 

Regardless of stating every condition and information about the trips on the website and brochures of the company, we still cannot be held responsible for the unforeseeable situations that may arise due to the civil unrest in the country. The company can however try its level best to give a prior notice about it and take alternate strategies to deal with it. These booking conditions may only be waived in special circumstances, and in writing, by a letter from the Chief of the Company. Note that all the legal agreements set up and signed between the clients and the company shall be subjected to and governed by the Nepalese law. 

 

Note: All the Terms and Conditions mentioned are prepared under the laws of the Government of Nepal and is governed by them. Therefore, only the head of the company gets to intervene and holds the authority to make any amendments.
